IN RE PETITION OF NICOLE R. GALLAGHER FOR REINSTATEMENT TO ACTIVE STATUS IN THE STATE BAR OF MONTANA
Nicole R. Gallagher has petitioned this Court for admission to active status in the State Bar of Montana after having voluntarily chosen inactive status in June of 2007. Gallagher states she has been charged with a criminal offense while not on active status: attempt to possess paraphernalia, under the Arizona Criminal Code.
IT IS ORDERED that Petitioner must submit to an investigation by the Commission on Character and Fitness concerning her fitness to practice law. Petitioner must comply with the character and fitness process and timely produce information, evidence, and documentation as requested by the Commission. The Commission may, in its discretion, conduct a limited investigation.
IT IS FURTHER ORDERED that, when its investigation has been completed, the Commission will advise the Court whether Petitioner has been certified, conditionally certified, or denied certification. If the Commission grants certification or conditional certification, it shall file a Certificate of Certification under the above Cause Number with the Clerk of this Court. If the Commission denies certification, it will issue written findings of fact, conclusions of law, and a decision as per Section 5(c)(6) of the Rules of Procedure of the Commission on Character and Fitness.
IT IS FURTHER ORDERED that, if Petitioner is certified or conditionally certified to practice law in Montana, she shall, within six months of the date of that certification, submit to the Board of Continuing Legal Education, P.O. Box 577, Helena, MT 59624, proof of attendance at thirty hours of approved Continuing Legal Education to be credited to the time she was on inactive status.
