IN THE MATTER OF: A.T. and R.T., Youths in Need of Care.
Appellant filed the opening brief on July 5, 2013. Pursuant to Rule 1 l(4)(e) of the Montana Rules of Appellate Procedure, this Court requires that a brief contain a signed certificate of compliance which states the document's line spacing and either: 1) the document is proportionately spaced, together with the typeface, point size, and word count; or 2) the document uses a monospaced typeface, together with the number of characters per inch and word count, or, the number of counted pages, pursuant to section (4)(b) of this rule. The party preparing this certificate may rely on the word count of the word processing system used to prepare the brief. The certification is not included in calculating the document's length.
Appellant's brief does not comply with the above Rule. Accordingly,
IT IS ORDERED that, within ten days of the date of this Order, ten copies of the signed Certificate of Compliance must be filed by Appellant with the Clerk of the Supreme Court, as well as copies mailed to all counsel of record.
IT IS FURTHER ORDERED that a certificate of service must be filed showing the date the Certificate of Compliance was mailed and to whom it was mailed.
IT IS FURTHER ORDERED that the times for any subsequent briefing contained in M. R. App. P. 13 shall continue to run from the date of filing of the Appellant's brief on July 5, 2013.
The Clerk of Court is directed to mail a true copy of this Order to all counsel of record.
