Morrow v. Bank of America, N.A.

Supreme Court of Montana

July 24, 2013

ABRAHAM B. MORROW and BETTY JEAN MORROW, Plaintiffs and Appellants,
v.
BANK OF AMERICA, N.A., BAC HOME LOANS SERVICING, LP, fka COLTNTRYWIDE HOME LOANS SERVICING, LP, Defendants and Appellees.

ORDER

Appellee Bank of America, N.A., has moved for leave to file an over-length brief in this matter. The Bank contends an expansion of the word limit is necessary to allow it to respond to issues and arguments raised in briefs filed by amicus curiae in support of the Appellants' position. Appellants have filed written objections to the motion to file an over-length brief.

After due consideration,

IT IS ORDERED that the motion for leave to file an over-length brief is DENIED. To the extent issues raised by amici address matters not considered by the District Court, they will not be addressed by this Court.

The Clerk is directed to provide copies of this order to all counsel of record.
