Palmer v. Quinn

Supreme Court of Montana

July 30, 2013

M. STAGEY PALMER INDIVIDUALLY AND AS TRUSTEE OF THE M. STAGEY PALMER TRUST, Plaintiff and Appellant,
v.
ROBERT QUINN, AFM GONTRAGTING, SHAWN JOHNSTON, STEVE JOHNSTON, and GARY PERREN and GITY OF THREE FORKS, MAYOR GENE TOWNSEND, RAY NOBLE, and G & H ENGINEERING & SURVEYING, INC., MARK GHANDLER, MATT GOTTERMAN and JOHN DOES 1 THROUGH 20, Defendants and Appellees. v.

ORDER

Plaintiff and Appellant M. Stacey Palmer has moved to supplement the record on appeal and for an extension of time to file her opening brief on appeal. Palmer asks to supplement the record with a transcript of testimony by Gary Perren, and "the Case Register Report AND 1.000, 47.000-50.000, 67.000, 111.000, 120.000-122.000, 182.000<187.000." Palmer's motion for an extension of time is based both on the request to supplement the record and on a family reunion she plans to attend '4n early August."

The transcript of Mr. Perren's testimony was filed with the Clerk of this Court on July 5, 2013. Further, Palmer is advised that, as is the case in all appeals, all documents in the District Court record have been filed with the Clerk of this Court. That record includes the documents docketed under the above-listed numbers.

The motion to supplement the record appearing to be moot because the requested documents already have been filed,

IT IS ORDERED that Palmer is granted a 30-day extension of time, until September 3, 2013, in which to prepare, file, and serve her opening brief on appeal.
