ORDER

In a March 20, 2013 Order, this Court denied Casey Clinton Ridge's (Ridge) petition for an out-of-time appeal in Missoula County Cause No. DC-09-226. He filed a motion to reconsider petition for out-of-time appeal, setting forth various issues he raises for the first time. We directed the Missoula County Attorney to file a response, and on his behalf, the Attorney General has filed the response. We deem the matter a petition for rehearing.

Having considered the disposition of the charges in DC-09-226, and the benefit Ridge achieved, we are not persuaded that he has established that denying him an out-of-time appeal in this matter would result in a gross miscarriage of justice. We also observe that Ridge presently has an appeal pending before this Court in DA 13-0102, State v. Ridge, for the subsequent bail-jumping convictions. This Court will consider that appeal in due course.

IT IS ORDERED that the motion to reconsider petition for an out-of-time Appeal is DENIED. The Clerk is directed to provide a copy hereof to counsel of record and to Casey Clinton Ridge.
