In re C.S.

Supreme Court of Montana

August 13, 2013

IN THE MATTER OF C.S., A Youth in Need of Care and Petitioner,
v.
THE MONTANA SECOND JUDICIAL DISTRICT COURT, BUTTE SILVERBOW COUNTY, MONTANA, JUDGE BRAD NEWMAN, PRESIDING, Respondent.

ORDER

This matter comes before the Court on the petition of C.S. for writ of supervisory control. The underlying matter is a motion filed in the Second Judicial District Court, Silverbow County, denominated In the Matter of C.S, , Cause No. DN-13-4, by C.S.'s foster parent to vacate the appointment of a surrogate parent for C.S. made by Butte School District No. 1. The District Court denied the motion. Petitioner requests supervisory control over the District Court and urgency rendering the appeal process inadequate. Petitioner asserts the School District erred in appointing its own choice for surrogate parent for an adult student with Autism, instead of moving for the appointment of an involved foster parent. In consideration thereof,

IT IS HEREBY ORDERED, pursuant to M. R. App. P. 14(7), that the Respondent District Court and/or Butte School District No. 1 are granted twenty days to file a response to the petition for writ of supervisory control. The Clerk is directed to provide copies of this Order to counsel for all parties in Butte Silverbow County Cause No. DC-13-4, and to the Honorable Brad Newman, presiding District Judge.
