CR Weaver v. Tri-County Impelement, Inc.

Supreme Court of Montana

August 14, 2013

CR WEAVER, Plaintiff and Appellant,
v.
TRI-COUNTY IMPELEMENT, INC., and TAMI CHRISTENSEN, Defendants and Appellees.

ORDER

The record was filed for purposes of this appeal on April 25, 2013. On July 10, 2013, we ordered Appellant CR Weaver to file his opening brief, which was then overdue, within 30 days or risk dismissal of this appeal with prejudice and without further notice. Weaver has now requested a 60-day extension of time to file his opening brief. Appellees Tri-County Implement, Inc., and Tami Christensen have filed a brief in opposition to that request, in which they point out that Weaver's motion does not comply with several procedural requirements of the Montana Rules of Appellate Procedure. Appellees ask the Court to deny the motion for extension of time and dismiss this appeal with prejudice.

After consideration of the motion for extension of time and response,

IT IS ORDERED that Weaver is granted an extension of time until August 30, 2013, in which to prepare, file with the Clerk of this Court, and serve upon opposing counsel his opening brief on appeal. Absent demonstration of truly extraordinary circumstances, no further extensions will be granted for the filing of Weaver's opening brief.

The Clerk is directed to provide copies of this order to all counsel of record.
