Knox LLC v. Montana Second Judicial District Court

Supreme Court of Montana

August 19, 2013

KNOX LLC, Petitioner,
v.
MONTANA SECOND JUDICIAL DISTRICT COURT, SILVER BOW COUNTY, AND THE HONORABLE KURT KRUEGER, PRESIDING JUDGE, Respondent.

ORDER

Petitioner Knox, LLC (Knox) requests that this Court exercise supervisory control over the Second Judicial District Court in relation to Hill County Cause No. DV-07-154. Specifically, Knox seeks the disclosure of certain financial information from Harold Carl Johnson which Knox believes is necessary to present his case. Knox represents that the District Court is proceeding under a mistake of law and causing a gross injustice by refusing to compel disclosure. We deem it necessary to receive a response from the District Court and the parties in DV-07-154.

Accordingly,

IT IS HEREBY ORDERED that the Respondent, Honorable Kurt Krueger, District Judge, or his designee, shall have 20 days from the date of this Order within which to file a response to the Application for Writ of Supervisory Control.

IT IS FURTHER ORDERED that any other party to these proceedings shall have 20 days from the date of this Order within which to file a response to the Application for Writ of Supervisory Control.

The Clerk of this Court shall provide notice of this Order to all counsel of record, and to the Honorable Kurt Krueger, District Judge, Montana Second Judicial District Court, under Cause Number DV-07-154.
