State v. Aragon

Supreme Court of Montana

September 24, 2013

STATE OF MONTANA, Plaintiff and Appellee,
v.
BENJAMIN ARAGON, Defendant and Appellant.

ORDER

Montana Rules of Appellate Procedure 10(2) requires that in appeals involving criminal matters, all transcripts, briefs, motions, and other papers shall be served on the Attorney General.

Appellant's principal brief was filed with this Court on September 24, 2013. The Certificate of Service in Appellant's principal brief indicates that it was mailed, but does not specifically state that it was mailed to the Attorney General. Therefore, the brief does not comply with M. R. App. P. 10(2). Accordingly,

IT IS ORDERED that within ten days of the date of this Order, Appellant serve the Attorney General with a copy of his principal brief.

IT IS FURTHER ORDERED that Appellant file with the Clerk of this Court a signed Certificate of Service showing the date service was made and the names of the persons served.

IT IS FURTHER ORDERED that the times for any subsequent briefing, if any, pursuant to M. R. App. P. 13 shall run from the date the Clerk of this Court receives a signed Certificate of Service showing the date service was made and the names of the persons served.

The Clerk of Court is directed to mail a true copy of this Order to all counsel of record.
