Bruse v. Green

Supreme Court of Montana

October 15, 2013

ROBERT BRUSE, Petitioner,
v.
TOM GREEN, Dawson Correctional Facility, Respondent

ORDER

Petitioner Robert Mason Bruse (Bruse) has filed a petition for rehearing of our August 28, 2013 Order denying his petition for a writ of habeas corpus. He claims that Prison Records recalculations understate his actual time served and incorrectly extend his discharge date. As grounds for rehearing, he asserts that this Court overlooked factual material of the actual time Bruse has been incarcerated, and he asks this Court to advise the sentencing court of the correct amount of time for which he should be incarcerated on the present revocation sentence.

With respect to petitions for rehearing of orders disposing of motions or petitions for extraordinary writs, this Court may not grant rehearing in the absence of "clearly demonstrated exceptional circumstances." M. R. App. P. 20(1)(d).

No exceptional circumstances have been demonstrated here.

Therefore,

IT IS ORDERED that the Petition for Rehearing is DENIED.

The Clerk is directed to provide a copy hereof to counsel of record and to Robert Bruse.
