JOSEPH ROBERTSON and CARRI ROBERTSON, Defendant and Appellant.

ORDER

Appellants Joseph and Carri Robertson (Collectively, "Robertsons") have filed a Motion for Appointment of Counsel in this appeal from a Fifth Judicial District Court, Jefferson County conviction for Theft and Criminal Trespass. In support of the motion, they indicate they were convicted of a crime for which incarceration is a possibility. Both were represented by counsel in their appeal before the Jefferson County District Court and state they are is financially unable to retain private counsel. They also state their belief that they are eligible financially for appointment of the Office of Appellate Defender to represent them.

It appears that Joseph and Carri Robertson may be entitled to appointed counsel in this appeal.

Therefore,

IT IS ORDERED that the motion for appointment of counsel is GRANTED.

The Office of Appellate Defender (OAD) is granted 30 days from the date of this Order within which to determine whether Joseph and Carri Robertson qualify for the appointment of counsel and to file either a notice of appearance or a motion to rescind this Order. The record indicates the transcripts have been filed with the Clerk of Court.

The Clerk of the Supreme Court is directed to provide a copy of this Order to the Office of Appellate Defender, counsel of record and to Joseph and Carri Robertson.
