IN RE THE PARENTING OF I.M.M. KIMBERLY LUTHER, Petitioner and Appellant, and JORAM MARTIN, Respondent and Appellee.

ORDER

Respondent Joram Martin (Martin) has filed a motion to dismiss the appeal filed by Appellant Kimberly Luther (Luther). Martin alleges that Luther has failed to "follow the rules set forth by Court for filing of Opening Brief." Luther objects to Martin's motion. Luther points out that her opening brief must be filed by November 22, 2013.

Luther has yet to file her opening brief. We cannot determine at this juncture whether Luther's yet to be filed opening brief follows the rules set forth by this Court. We do note, however, that these parties have filed multiple motions related to the appeal in this matter. The parties, and the Court, will be relieved once they file the briefs in this matter so that the Court can resolve this appeal in an expeditious manner and without further motions.

Accordingly, it is ordered that Martin's motion to dismiss the appeal is DENIED. The Clerk is directed to provide a copy hereof to the parties hereto.
