State v. Kinlock

Supreme Court of Montana

November 14, 2013

STATE OF MONTANA, Plaintiff and Appellee,
v.
CLIVE WELLINGTON KINLOCK, Defendant and Appellant.

ORDER

Appellant Clive Wellington Kinlock (Kinlock) has moved for the appointment of the Office of Appellate Defender to represent him in this appeal from an Order of the Eighth Judicial District Court that denied his motion to withdraw his guilty plea in Cause No. BDC-91-205. Kinlock was convicted and sentenced for aggravated kidnapping, aggravated felony assault, and a weapon enhancement in May of 1992. He asserts that the District Court refuses to address a fundamental miscarriage of justice.

Kinlock offers no factual or legal support for his contentions. Accordingly, there is no justification for appointing counsel to address issues arising from convictions arising from guilty pleas that were entered more than 20 years ago.

IT IS ORDERED that the motion for appointment of appellate counsel is DENIED.

The Clerk is directed to provide a copy hereof to counsel of record and to Clive Wellington Kinlock.
