State v. Ghostbear

Supreme Court of Montana

January 3, 2014

STATE OF MONTANA, Plaintiff and Appellant,
v.
EDWARD HAROLD GHOSTBEAR, Defendant and Appellee.

ORDER

Edward Harold Ghostbear, who is represented in this appeal by Koan Mercer of the Appellate Defenders Office, previously has been granted an extension of time until January 17, 2014, in which to file his brief on appeal. Ghostbear has now personally filed a letter requesting an extension of time until February 17, 2014, in which to do his own research and discuss the appeal with Mercer, Ghostbear also asks this Court to appoint different counsel to represent him on appeal—a request that we previously have denied—or, alternatively, to send him information on how he can proceed pro se.

Ghostbear is advised that, as long as he is represented by counsel, all of his filings with this Court should be made through his counsel. However, in light of Ghostbear's stated wish to explore the possibility of proceeding pro se in this appeal,

IT IS ORDERED that Ghostbear is granted an extension of time until February 17, 2014, to discuss his options with his counsel and to file his brief on appeal.

The Clerk is directed to provide copies of this order to all counsel of record and to Edward Harold Ghostbear personally.
