Baumgart v. State, Dept. of Commerce

Supreme Court of Montana

January 7, 2014

ELIZABETH "BETSY" BAUMGART, Plaintiff and Appellant,
v.
STATE OF MONTANA, DEPT. OF COMMERCE, and DOES 2-15, inclusive, Defendants and Appellees.

ORDER

M. R. App. P. 12(l)(f) requires that the argument portion of the brief of the appellee be preceded by a summary, under an appropriate heading, which contains a succinct, clear, and accurate statement of the arguments made in the body of the brief and not a mere repetition of the argument headings.

The Court has determined that Appellee's brief filed January 6, 2014, does not comply with this Rule. Therefore,

IT IS ORDERED that within ten days of the date of this Order the Appellee shall file with the Clerk of this Court an original and nine copies of a summary of the argument and serve a copy on all counsel of record;

IT IS FURTHER ORDERED that the times for any subsequent briefing contained in M. R. App. P. 13 shall run from the date of filing of the summary of the argument.

The Clerk is directed to mail a copy of this Order to counsel for Appellee and provide a copy of this Order to all counsel upon whom the brief was served.
