IN THE MATTER OF JEFFREY G. MICHAEL An Attorney at Law, Respondent.
PROCEEDING IN PUBLIC CENSURE
McGRATH CHIEF JUSTICE
This is the time set for the public censure of Jeffrey G. Michael, a member of the State Bar of Montana. Before we begin, we make a correction to our Order of Discipline entered on November 26, 2013. That order referred to a July 19, 2012 hearing held in this matter before the Commission on Practice. That hearing was, in fact, held on July 19, 2013. Our November 26 order is so corrected.
Sir, are you the Jeffrey G. Michael who is the subject of disciplinary action in this Court under our Cause Number 12-0671? Do you have counsel?
Mr. Michael, if you will now come to the well of the Court in front of the rostrum and face the Court, we will proceed with your public censure.
Mr. Michael, this public censure is being delivered today in accordance with our order of November 26, 2013, a copy of which was served upon you. It is based on your abusive, disruptive, and threatening conduct toward another attorney on two separate occasions in 2011 and 2012. Your conduct on those two occasions was prejudicial to the administration of justice, in violation of Rule 8.4(d) of the Montana Rules of Professional Conduct.
Mr. Michael, we hereby impose upon you the public censure of this Court.
Do you have anything you want to say?
Copies of this Proceeding in Public Censure shall be delivered to you, Mr. Michael, the Chair and Secretary of the Commission, Disciplinary Counsel, the Clerks of all of the District Courts of the State of Montana, all of the District Judges of the State of Montana, the Clerk of the Federal District Court for the District of Montana, the Clerk of the Circuit Court of Appeals of the Ninth Circuit, and the Executive Director of the State Bar of Montana.
