State v. White

Supreme Court of Montana

January 9, 2014

STATE OF MONTANA, Plaintiff and Appellee,
v.
JOEL M. WHITE, Defendant and Appellant.

ORDER

This appeal has been fully briefed and scheduled for classification in due course. Appellant Joel M. White represented himself through the process, while the Attorney General represented the State. During classification, the Court determined that supplemental briefing would be beneficial to the Court. We have, therefore, referred this matter for the appointment of counsel to represent the Appellant and submit supplemental briefing by way of the Court's Appellate Pro Bono Program. This program was established by Order dated May 22, 2012, In the Matter of Establishing an Appellate Pro Bono Program, No. AF 13-0028.

Jeffry M. Foster, an attorney in good standing, has volunteered to file a supplemental brief and Mr. White has consented.

THEREFORE, IT IS ORDERED that Jeffry M. Foster is appointed to represent Appellant Joel M. White under the procedures of the Appellate Pro Bono Program.

IT IS FURTHER ORDERED that the Appellant's supplemental brief shall be filed and served on or before March 10, 2014.

IT IS FURTHER ORDERED that the Appellee is granted 30 days from and after the date the Appellant's supplemental brief is served to file a supplemental brief.

No reply brief shall be allowed except upon leave of Court and a showing of good cause.

If oral argument is requested by either party, the Court shall consider the request in the classification process.
