In re Marriage of Carter-Scanlon

Supreme Court of Montana

January 13, 2014

IN RE THE MARRIAGE OF: LONA ANN CARTER-SCANLON, Petitioner and Appellee,
v.
JOSEPH D. SCANLON, Respondent and Appellant. and

ORDER

M. R. App. P. 10(2) requires that copies of all papers shall, at or before the time of filing, be served by the party on all other parties to the appeal. Service on a party represented by counsel shall be made on counsel.

The Court has determined that Appellee Mother's response brief filed January 10, 2014, does not comply with the referenced Rule, as the certificate of service does not indicate that Appellee Mother's brief was served upon Greg Daly, counsel for Guardian ad Litem. Therefore,

IT IS ORDERED that within 10 days from the date of this Order Appellee Mother shall serve a copy of her brief upon Greg Daly;

IT IS FURTHER ORDERED that Appellee Mother shall file with the Clerk of this Court and serve a copy upon all parties of record, a certificate of service indicating that a copy of her brief has been served upon Greg Daly;

The Clerk is directed to provide a copy of this Order to Appellant Father and to all parties of record.
