In re Appeal of Windsor

Supreme Court of Montana

January 21, 2014

IN RE THE APPEAL OF: WILLIAM M. WINDSOR, Petitioner and Appellant,
v.
SEAN BOUSHIE, Respondent and Appellee.

ORDER

William Windsor, appearing as a self-represented litigant, has filed a motion for order to authorize service on Sean Boushie, and a motion to strike. In his motion for order to authorize service, Windsor complains that the respondent Sean Boushie is not receiving the documents he is serving. In light of the order of protection that is in place against Windsor, Windsor is not to serve documents of any sort upon Boushie, with the sole exception that he is required to serve Boushie with his appellate briefs in this and other pending appeals, in the manner set forth in the Montana Rules of Appellate Procedure. In his motion to strike, Windsor asks that we strike Boushie's response to his appellate brief because it is not properly signed or sworn. This Court is capable of evaluating the legality and validity of Boushie's response brief. Accordingly,

IT IS HEREBY ORDERED that Windsor's motion for order to authorize service and motion to strike are DENIED.

IT IS FURTHER ORDERED that Windsor shall refrain from filing any further motions with this Court in this cause, as briefing has concluded and the matter is presently before the Court on classification.
