ORDER

Montana Rule of Appellate Procedure 10(2) requires that in criminal cases appealed by the defendant, all briefs shall be served on both the prosecuting attorney and the attorney general. While the Certificate of Service contained in Appellant's Brief filed with this Court on March 3, 2014, indicates Appellant's Brief was served on the Office of the Attorney General, it appears the Missoula City Attorney was not served with a copy of Appellant's Brief.

Montana Rule of Appellate Procedure 12(l)h, requires that the judgment, order, findings of fact, conclusions of law, or decision in question, together with the memorandum opinion, if any, in support thereof, be contained in Appellant's Brief to this Court. Appellant's Brief filed with this Court on March 3, 2014, contains neither the judgment or order of the Municipal Court nor the order of the Fourth Judicial District Court, Missoula County, from which the appeal is taken.

Therefore, IT IS ORDERED that within ten days of the date of this Order, Appellant shall file ten copies of the judgment or order appealed from with the Clerk of this Court and serve one copy upon the Attorney General;

IT IS FURTHER ORDERED that Appellant shall serve a copy of Appellant's Brief, including the judgment or order appealed from, on the Missoula City Attorney;

IT IS FURTHER ORDERED that once Appellant's Brief is served upon the Missoula City Attorney, Appellant shall file with the Clerk of this Court a corrected Certificate of Service indicating such service;

IT IS FURTHER ORDERED that the corrected Certificate of Service be filed within ten days of the date of this Order;

IT IS FURTHER ORDERED that the times for any subsequent briefing contained in M. R. App. P. 13 shall run from the date of filing of the judgment or order appealed from, or the corrected Certificate of Service, whichever is later; and

IT IS FURTHER ORDERED that the Clerk of this Court is directed to mail a true copy of this Order to all counsel of record.
